Terms of Use
Free Beta Version
Effective Date: 30 September 2026 Version: 2026-09-30
Before you start
These Terms are a contract between you and us. Please read them. They are short, and we have tried to write them so you can.
Three things matter most:
- You are our customer. Your child is our user. You hold the account, you accept these Terms, and you are responsible for your child's use of BigPetPal.
- The pet is a computer program, not a person and not a real animal. It uses artificial intelligence to work out what to say, and it speaks its replies aloud. It will sometimes get things wrong.
- BigPetPal is not a substitute for you. It is a toy and a companion. It is not care, not supervision, not education and not therapy.
1. Who we are
BigPetPal is operated by IdeaHub Pty Ltd (ABN 58 647 220 380, ACN 647 220 380), an Australian company trading as BigPetPal. In these Terms, "we", "us" and "our" mean IdeaHub Pty Ltd.
Suite 606, Level 6, 11-15 Deane Street, Burwood NSW 2134, Australia General enquiries: info@bigpetpal.com Privacy: privacy@bigpetpal.com
2. Where we offer BigPetPal
We offer BigPetPal in the countries listed in Schedule 1. At present that is Australia only.
You may only create an account and use BigPetPal if you are resident in a country listed in Schedule 1. If you are not, you may not create an account, and we may close an account that we find has been created outside those countries.
3. The Account Holder
3.1 Who can open an account
To open a BigPetPal account you must:
- be at least 18 years old;
- be the parent or legal guardian of every child whose profile you create, and have parental responsibility for that child; and
- be resident in a country listed in Schedule 1.
A child cannot hold an account. Your child has no login of their own, cannot sign in unaided, cannot change any setting, and cannot buy anything.
3.2 The person who creates the account is the Account Holder
The person who creates the account is the Account Holder, and remains the Account Holder. The Account Holder controls the account.
Only the Account Holder may:
- manage the account and change its settings;
- add, change or remove a child profile;
- grant another adult access to the account, and withdraw that access;
- give or withdraw any consent, including consent to safety screening and to memory extraction;
- purchase a subscription, when subscriptions begin; and
- ask us to delete the account, or any child profile on it.
By creating a child profile, the Account Holder confirms that they are that child's parent or legal guardian, that they have parental responsibility for that child, and that they are entitled to consent to the child's use of BigPetPal and to our handling of the child's information.
3.3 Giving another adult access
The Account Holder may invite another adult to the account, for example the child's other parent or a carer.
A person given access can see the child's profile, conversations, transcripts, summaries and safety alerts. They cannot take any of the actions listed in clause 3.2. Those remain with the Account Holder alone.
The Account Holder can withdraw that access at any time.
3.4 If someone else contacts us about a child on your account
If another person contacts us about a child on your account, including another parent or guardian, we will direct them to the Account Holder. We will not add them to the account, change the account, or delete anything, on their request.
We will depart from that only where the law requires us to, or where a court or tribunal orders it. If that happens, we will tell the Account Holder unless we are prevented from doing so.
This clause governs who controls the account. It does not affect any right a person has under privacy law, and we will deal with a request made under privacy law as that law requires.
3.5 Your responsibilities
You agree that:
- you decide whether and when your child uses BigPetPal;
- you are responsible for supervising that use, and for the device you hand to your child;
- you are responsible for everything done on your account, including by anyone you have given access to; and
- you will keep your login details to yourself.
4. Your child's use of BigPetPal
We grant you a personal, non-exclusive, non-transferable and revocable permission to let the children named on your account use BigPetPal on your devices, for your family's own personal use.
We do not have a contract with your child. A child of the age BigPetPal is built for cannot enter into one. Your child uses BigPetPal because you permit them to, on your account and under your supervision.
5. What BigPetPal is, and what it is not
The pet is a computer program. Its replies are generated by artificial intelligence, one word at a time, in response to what your child says. Its voice is synthesised. It is not a person, not a real animal, and has no feelings or understanding in the way a person does. The pet tells your child this too, in words a young child can follow.
The pet will sometimes be wrong. AI systems produce mistaken, odd or inappropriate output. We have built safeguards, described in clause 6 and in our Privacy Policy, and they will not catch everything. Please use the parent portal. It exists so you can see what is actually being said.
BigPetPal is not:
- a substitute for your supervision, attention or care;
- an educational programme, a tutor or a therapist;
- a source of medical, psychological, safety or any other advice; or
- a monitoring service that will identify every concerning thing your child says.
If you are worried about your child's wellbeing, please speak to a doctor or another qualified professional. Do not rely on BigPetPal to tell you.
6. Safety features, and their limits
BigPetPal reads what your child says and flags things that may concern you. How it works is described in our Privacy Policy.
What we do. The pet is instructed to respond safely in the moment. After each conversation an AI reads the transcript and rates it. If something serious is flagged, we email you and show it in your parent portal. In severe cases we may pause a child's profile automatically and tell you at the same time. Contact us and we will review it.
What we do not do. We do not monitor in real time. We do not guarantee that anything in particular will be detected. We do not tell anyone other than you, except as our Privacy Policy describes.
The safety features are an aid to you. They are not a safety net and must not be treated as one. A flag that does not appear does not mean nothing was said.
The pet will never keep a secret. It is built so that it cannot agree to keep anything from you, and it tells your child so.
7. Privacy
Our Privacy Policy explains what we collect about you and your child, who else handles it, where it is stored, how long we keep it and how to have it deleted. It forms part of your relationship with us and you should read it before you accept these Terms.
The two points we most want you to have seen:
- We record your child's voice, and that recording is sent to companies outside Australia to be processed.
- Our database is in India. Your child's voice recordings are stored separately, in Australia and New Zealand.
Both are explained in full in the Privacy Policy.
8. Using BigPetPal properly
You agree not to:
- let anyone outside your household use your account;
- use BigPetPal for anyone other than a child in your care;
- try to get around the content filters or safety features;
- deliberately try to make the pet produce harmful, unlawful or inappropriate content;
- use BigPetPal to break the law;
- copy, reverse engineer, decompile or try to extract our software, our prompts or the AI models behind BigPetPal;
- scrape, bulk download or resell anything from BigPetPal; or
- interfere with the service or try to get access you have not been given.
If you break these, we may suspend or close your account. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.
9. Who owns what
We own BigPetPal. All software, the pet character, artwork, sounds, branding and content are owned by IdeaHub Pty Ltd or licensed to us, and are protected by copyright and trade mark law. Nothing in these Terms transfers any of that to you.
You and your child own what your child says. The recording of your child's voice, and the words your child speaks, belong to your child. They are not ours.
You give us permission to record, store, transcribe and process that material, and to send it to the service providers named in our Privacy Policy, only so that we can:
- make BigPetPal work for your child;
- show it to you in the parent portal;
- run the safety features; and
- keep the service running and fix problems.
That permission lasts while you have an account, and ends when the material is deleted.
We will not use your child's voice or words to train AI models. We will not license, sell or share them for anyone else to do so. We will not use them in advertising or marketing.
The pet's replies are generated by AI. We make no claim to own them, and we do not warrant that they are original or that they may be used for any purpose outside BigPetPal.
10. This is a free beta
BigPetPal is currently in public beta and is free. There is no charge, no subscription and no trial that converts into one.
Because it is a beta:
- features will change, be added or be removed without notice;
- the service may be unavailable, slow or interrupted;
- there are no service levels and no uptime commitment;
- data may be lost, and you should not treat BigPetPal as the only place anything is stored; and
- we may end the beta, or stop offering BigPetPal, at any time.
We will never charge you anything unless you have separately agreed to a paid subscription first.
If we introduce charges, we will tell you beforehand and you can decide whether to subscribe. If you decide not to, you can close your account at any time and have your child's information deleted, as clause 12 describes.
Nothing in this clause limits your rights under the Australian Consumer Law described in clause 11. We are describing what the service is, not taking away anything the law gives you.
11. Our responsibility to you
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees, and any part of these Terms that tried to would have no effect.
Subject to that, and to the extent the law allows:
- we are not liable for loss that was not reasonably foreseeable;
- we are not liable for indirect or consequential loss;
- we are not liable for loss caused by something outside our reasonable control; and
- we are not liable for how you or your child choose to use BigPetPal, or for decisions you make based on what you see in the parent portal.
We do not limit our liability for fraud, for death or personal injury caused by our negligence, or for anything else the law does not permit us to limit.
12. Ending your account
You can leave at any time, for any reason or none. Use the request form at www.bigpetpal.com/delete, or email privacy@bigpetpal.com. Only the Account Holder can make this request.
We will delete your account and your child's information as set out in our Privacy Policy.
We may close your account if you break these Terms, if we reasonably believe your account is being used unsafely or unlawfully, if we are required to by law, or if we stop offering BigPetPal. Except where we cannot, we will tell you first and give you a chance to respond.
If we close your account, we will delete your child's information on the same basis as if you had asked us to.
13. Changes to these Terms
We version these Terms by date.
Every new version of these Terms, including a correction and including any change to Schedule 1, requires you to read and accept it before you can keep using BigPetPal. We will not change this contract without asking you.
You can see which version you accepted, and when, in your parent portal.
A new version carrying subscription and billing terms will be issued when BigPetPal becomes a paid service. You will be asked to accept it before any charge is made.
14. General
Governing law. These Terms are governed by the law of New South Wales, Australia.
Courts. The courts of New South Wales have non-exclusive jurisdiction. This does not affect any right you have to bring proceedings in the courts of the State or Territory in which you live.
Language. These Terms are in English.
If part of these Terms does not work. If any part is found to be unenforceable, the rest continues to apply.
Transfer. You may not transfer your account or your rights under these Terms. We may transfer ours if our business is sold or restructured, and we will tell you if that happens.
The whole agreement. These Terms and our Privacy Policy are the whole of what is agreed between us about BigPetPal.
